Defects in a lender’s security instrument or other documentation may impact a lender’s ability to enforce their lien through foreclosure. Common defects can include, but are not limited to; a failure to record, failures to properly execute, and errors in the legal description. If a defect is discovered, Activist Legal and local counsel can review the defect and determine the best course of action to cure the defect.

If title insurance is available on a deed of trust or mortgage, Activist Legal and local counsel can assist with the filing of a claim with the insurer.
If the title insurer denies the claim or title insurance is not available, Activist Legal work with local counsel to file a complaint to seek a judgment from the court to cure the title defect.
